Concern for HB 325 / SB 390 – Provision of Veterinary Services – Routine Medical Care and Rabies Vaccines

MDVMA needs you, our valued members, more than ever. Please take the time to share your concern and/or opposition for House Bill 325 and Senate Bill 390.

What is the synopsis?

HB 325  and  SB 390  will require the State Board of Veterinary Medical Examiners to authorize a veterinary practitioner licensed, certified, or otherwise authorized to practice veterinary medicine in another state or jurisdiction to provide routine medical care in the State under certain circumstances; and requiring the Secretary of Health to allow individuals who work in or for a certain veterinary hospital or a certain animal control facility to administer rabies vaccines under certain circumstances.

Why should the veterinary profession be concerned?

HB 325 and SB 390 will allow veterinarians from any state or jurisdiction to practice within Maryland without a license, effectively making the Maryland Practice Act impossible to enforce. Licensure is the only method of recourse the State Board of Veterinary Medical Examiners (SBVME) has to limit the inappropriate practice of veterinary medicine.

Shelter animals and Maryland citizens who require financial assistance are worthy of quality veterinary care. Taking this unprecedented step to neutralize the purpose of the SBVME is dangerous and does nothing to address a perceived veterinary shortage. Removing the regulatory guardrails that prevent low quality medicine and allow veterinarians to operate in Maryland with impunity would be a dire miscalculation.

Time to Take Action

HB 325 and SB 390 are scheduled to be heard in their respective committees on Wednesday, February 15 . We implore you to reach out to by email, phone, or both to voice your concerns to these legislators:

  1. House Environment and Transportation Committee,
  2. Senate Education, Energy, and the Environment Committee, and
  3. Sponsoring members in the House and Senate.

I’m writing today as a concerned veterinarian within the state of Maryland regarding {INSERT BILL}.

As written, this bill will allow veterinarians from any state to practice within Maryland making it effectively impossible to enforce the Maryland practice act. Furthermore, it virtually invalidates the need for a Maryland veterinary license. In addition, it takes an unprecedented step to effectively neutralize the ability of the Maryland State Board of Veterinary Medical Examiners (SBVME) to regulate veterinarians practicing within the state. It is dangerous and it does nothing to address a perceived veterinary shortage.

Shelter animals and citizens of Maryland who require financial assistance are worthy of quality veterinary care. They should not be subjected to services rendered by an unchecked, unregulated veterinarian as a matter of convenience. Creating financial incentives to support those services would be a far better legislative initiative.

The SBVME has an excellent track record of regulating veterinary medicine in our state, punishing bad behavior and it will restrict licensure only when an individual applying has demonstrated a prior disregard for the safe practice of veterinary medicine. Removing the regulatory guardrails that prevent low quality medicine and allow veterinarians to operate in Maryland with impunity would be a dire miscalculation.

The University of Maryland Department of Veterinary Medicine has been cleared to collect samples as part of a research investigation into the causative agent to help our Maryland veterinary community and not as a fee for service diagnostic service . Participation and sending samples is encouraged and voluntary - at no cost - other than shipping to the veterinary clinic. The results will be communicated as a research report about the findings of the investigation and not on individual cases basis. As such the department of veterinary medicine is covering the cost of this investigation. It must be emphasized that at this time UMD is cleared to receive and store the samples that meet their criteria for running metagenomic sequencing for investigation purposes. They will not be able to process samples until full protocol approval which they hope will happen on December 13. In addition, turnaround time on the final study report cannot be predicted as it depends on many factors including IBC protocol approval process and how quickly enough samples can be collected to run the testing. As many of you know, concerns about an outbreak of atypical canine infectious respiratory disease (CIRD) have been reported in areas all over the United States. This has dominated media outlets early in this holiday season. At this time, we are told several cases have been reported recently although we do know the actual number of cases reported. The Maryland Veterinary Medical Association (MDVMA) is aware of the concerns of the citizens of Maryland. CIRD is a broad term to describe known bacterial and viral causes of lung, trachea (throat), and nasal disease. The problem with atypical CIRD is that it does not always respond or behave like common CIRD. There has been very little and consistent data reported as the definitive pathogen causing this illness.
